TERMS AND CONDITIONS
1. PRELIMINARIES
1.1 ClaimThatLand.com (“CTL”, “we”, “our”, “us”) provides information and search services to identify unregistered land for potential claiming by customers (“the Customer”).
1.2 By placing an order with CTL, you agree to be bound by these Terms and Conditions (“the Terms”).
1.3 CTL does not provide legal, financial, or property ownership advice. All information supplied is for educational and informational purposes only. Customers should obtain independent legal advice before taking steps toward claiming and occupying land.
1.4 The land claiming process can vary depending on individual circumstances, council policies, and applicable laws.
1.5 CTL reserves the right to amend these Terms and our Privacy Policy at any time without prior notice. The latest version will always be available at www.claimthatland.com.
2. LAND CLAIMING PROCESS
2.1 Initial Search. Upon receipt of the initial search fee, CTL will conduct a search for unregistered land. Searches typically take 1–5 working days but may take longer. This fee is non-refundable once the land has been found.
2.2 Finder’s Fee. Once suitable land has been located, details (including approximate size and location) will be provided upon payment of the Finder’s Fee. Fees are displayed on our “How It Works” page.
2.3 Government Confirmation. CTL correspond with government authorities to verify whether the land is unregistered. Timelines are indicative and subject to government processing times.
2.4 Council Searches. CTL write to the council to assess any council or public use. If land is found to be ineligible, CTL may locate an alternative parcel of land. Council search fees are non-refundable.
2.5 Customer Responsibility. It is the Customer’s responsibility to take any steps required to assert possession of the land, such as the installation of signage indicating private ownership, and demonstrating use of the land.
2.6 Legal Documentation. CTL will provide documentation such as maps, search results, and draft statutory declarations upon full payment. Statutory declarations must be executed by your solicitor, which may be subject to a small fee. The statutory declaration is governed by the statutory declaration act 1835.
2.7 Timescales. Typical timescale ranges from 2 to 4 months, though this may extend due to government or local authority delays. In rare cases, the process may take several years.
2.8 Ownership. Identification of unregistered land does not confer legal ownership, possession rights, or title registration. The Customer must follow the correct legal process with appropriate professional assistance.
3. PAYMENT ARRANGEMENTS
3.1 The Customer has a 14-day cooling-off period from the date of the initial payment, provided CTL has not yet identified land. Once land has been found, the fee becomes non-refundable.
3.2 All prices include VAT unless stated otherwise.
3.3 Full payment is required before the release of final documentation.
3.4 Accepted payment methods include BACS transfer or payment links sent via email or WhatsApp.
3.5 CTL reserves the right to vary its pricing without prior notice. Current pricing can be found at “How It Works” page on www.claimthatland.com
4. CTL COMMITMENT TO YOU
4.1 CTL will provide its services with reasonable skill, care, and diligence.
4.2 All documents, correspondence, and searches will be provided once the relevant fees have been paid.
4.3 CTL reserves the right to withhold or reassign land information if fees remain unpaid.
4.4 CTL’s total liability shall not exceed the total amount paid by the Customer to CTL under these Terms.
5. LIMITATION OF LIABILITY
5.1 CTL shall not be liable for any indirect, incidental, or consequential losses, including but not limited to loss of profits, opportunities, or business.
5.2 CTL accepts no responsibility if a lawful titleholder or third party later challenges the Customer’s possession or claim to the land. The Customer may wish to obtain indemnity insurance via their solicitor.
5.3 CTL takes reasonable care in providing its services but does not warrant the accuracy, completeness, or success of any land claim.
5.4 The Customer assumes all risk and responsibility for any action taken in relation to identified land, including any loss, damage, injury, prosecution, or eviction.
5.5 Force Majeure. CTL shall not be held liable for any delay or failure caused by circumstances beyond its reasonable control, including but not limited to government delays, natural disasters, or communication failures.
6. OTHER TERMS
6.1 These Terms are governed by and construed in accordance with the laws of England and Wales.
6.2 The courts of England and Wales shall have exclusive jurisdiction over any disputes arising out of or relating to these Terms.
6.3 If any clause of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
7. COMMUNICATION
7.1 The Customer may contact CTL via email or WhatsApp, providing their name and postcode. CTL will respond within a reasonable time.
7.2 CTL may send communications, invoices, or updates electronically. By using this service, you consent to receive electronic communications from CTL.

ClaimThatLand.com (“CLT”) respects your privacy rights and promises to do its utmost to handle your data fairly and legally, and maintain its security.
Your privacy at CTL is important to CTL. Some personal data may be collected when using CTL’s services and any information used will be in accordance with the 2018 European General Data Protection Regulation (GDPR). CTL is governed by the Law of England and Wales.
CTL may collect and/or use your information when you use CTL’s website or social media channels, acquired from CTL, or use any other physical or electronic outlets connected to CTL.

1. Your rights
Your rights will be respected by CTL and include the following: the right to know that information may be collected, held and used by CTL; the right to rectify any data that may be out of date or incorrect; the right to restrict processing of data in some circumstances; the right to object to the use of data in some circumstances.
2. How your data is used
i) CTL and trusted partners may use your data to: verify your identity; provide goods and services to you; manage accounts in your name; restrict and prevent fraud and crime; better understand your needs.
ii) CTL may use your information for marketing purposes when you opt in to our newsletter or make a purchase. You have the right to opt out by unsubscribing from emails or changing the marketing preferences on your account.
iii) Your browsing information collected whilst using CTL’s website may inform advertisements you see on your computer and or other devices. These are collected using cookies on your devices. You may disable cookies at any time.
iv) CTL may collect and analyse information about you in order to send you product offers that are relevant to you. CTL may also share your personal information with third parties in order to enable certain services to function properly. CTL will not sell or rent any information collected to organisations for marketing purposes.
v) CTL may share your data with other third parties: to comply with our legal obligations; for the prevention, detection and investigation of fraud and other crimes; to exercise CTL’s legal rights; for credit reference agencies for such things as card payments; for the protection of staff and customers.
3. What personal data is collected
CTL may collect your: name, date of birth and gender information; contact details and postal address; browsing information through the use of cookies; feedback through surveys; purchase information; marketing and communication preferences; other information including publicly available data from places such as social media platforms.
4. How your data is protected
Steps are taken to protect your data as best as possible, such as using encryption and network protection, and limiting the number of people who can access your data.
5. What you can do to protect your data
CTL will not ask for sensitive data confirmation such as bank details. If correspondence of this nature is received, do not respond and alert relevant fraud prevention agencies.
If you are using a shared computer; log out once you are finished. Keep your private information, such as passwords, private. Use at least 8 characters including numbers and special characters when creating a password and change frequently.
6. Your rights relating to your data
If you wish to make a complaint, you have the right to do so through the Information Commissioner’s Office.
Changes in CTL’s Privacy Policy
CTL reserves the right to change this Privacy Policy at any time. If CTL decides to do this, an updated version will be uploaded to the Privacy Policy page of CTL’s website.
